DOJ issued a subpoena to CGMA regarding DOJ-COMELEC Case No. 001-2011 (Electoral Sabotage/Violation of Omnibus Election Code, etc. and DOJ-Comelec Case No. 002-2011 (Electoral Sabotage).

Subpoena was received by CGMA requiring her to appear in the preliminary investigation on November 3, 2011 at 2:00 pm.

During the hearing, the Panel, answering the query of counsels, said that the attachments in 001-2011 are the same attachments in the Pimentel complaint (002-2011), hence, no need to furnish copies of the attachments.

Ayunan, Susan U. Cananban, Russam H. Mabang, Asuncion Corazon P. Reniedo, Nena A. Alid, Ma. Susan L. Albano, Rohaida T. Khalid, Araw M. Cao, Jeehan S. Nur, Alice A. Lim, Norijean P. Hangkal, Christina Roan M. Dalope, and Maceda L. Abom be ADMINISTRATIVELY CHARGED; and
        c) That the charges against Jose Miguel T. Arroyo, Bong Serrano, Nicodemo Ferrer, Reuben Basiao, Albert Agra, Andrei Bon Tagum, Gabby Claudio, Romy Dayday, Jeremy Javier, John Doe a.k.a.. Butch be DISMISSED for insufficiency of evidence.

Comelec En Banc met at 7:30 a.m., and at 10:00 a.m. issued a Resolution approving and adopting the Joint Resolution of the Joint DOJ-Comelec Preliminary Investigation Committee, Subjecto to the following modifications:
        a) That Informations for the crime of Electoral Sabotage be filed against CGMA, Benjamin Abalos Sr., Lintang H. Bedol, Datu Andal Ampatuan Sr., and Peter Reyes
      b) That the charges against Michael C. Abas, Nicodemo Ferrer, Reuben Basiao, Jaime Paz and Norie K. unas be subjected to further investigation;
        c) That the charges against Jose Miguel T. Arroyo, Bong Serrano, Alberto Agra, Andrei Bon Tagum, Gabby Claudio, Romy Dayday, Jeremy Javier, John Doe a.k.a..Butch be DISMISSED for insufficiency of evidence.
       d) That the recommendation that Estelita B. Orbase, Eliza A. Gasmin, Eliza Z. Atinen, Saliao S. Amba, Magsaysay B. Mohamad, Salonga K. Edzela, Ragah D. Ayunan, Susan U. Cananban, Russam H. Mabang, Asuncion Corazon P. Reneido, Nena A. Alid, Ma. Susan L. Albano, Rohaida T. Khalid, Araw M. Cao, Jeehan S. Nur, Alice A. Lim, Norijean P. Hangkal, Christina Roan M. Dalope, and Maceda L. Abo be administratively charged be subjected to further review by this Commission to determine the appropriate charges that may be filed against them;

That the finding of lack of probable cause against Lilian S. Suan-Radam and Yogie G. Martirizar be rejected by reason of the pendency of their respective cases bedfore the RTC of Pasay (Branch 114) and the Commission for the same offense under consideration.

The Comelec files Electoral Sabotage charges against CGMA, Gov. Andal Ampatuan, and Atty. Lintang Bedol before the Pasay City Regional Trial Court.

It was received by the RTC-OCC Pasay City (Crim. Case Sec. & Cashier) at 11:22 AM.

On the same date at around 3:30 PM, Judge Mupas issued an Order finding probable cause against the accused and a warrant of arrest was issued. The judge personally evaluated the voluminous record of the case for almost three or not more than four hours only.

Arroyo was served the arrest warrant at St. Luke’s Medical Center in Taguig City at 6:30 p.m. in the presence of her husband.

CGMA filed Consolidated and Urgent Motions (1) To Suspend Proceedings, and (2) Objections to the Issuance of Warrant of Arrest and/or HDO.
CGMA also filed an Urgent Omnibus Motion Ad Cautelam.

Pasay RTC Judge Jesus Mupas issued on Order:
1. Motion for the issuance of HDO was DENIED
 2. RTC has the jurisdiction over the case
 3. Court noted the manifestation of Atty. Santos to take a second look on the judicial determination of probable cause.
 4. Motion for Temporary Hospital Arrest was GRANTED.
5. Counsel for the Comelec was hereby given a period of three days from receipt of the Urgent Omnibus Motion filed by CGMA to file their comment.

Defense withdrew motion for hospital arrest; moved for house arrest.
Dr. Mario Ver testified  as to the current medical condition of CGMA
Defense given 15 days within which to file motion for re-determination of probable cause
Lawyer Maria Juana Valesa, lead prosecutor of the Comelec in the case, moves for the immediate transfer of Arroyo from the hospital to jail after her doctors testified that Arroyo is now fit to leave the hospital.

In an order dated November 29, 2011 Judge Mupas ordered the transfer of CGMA to Veterans Memorial Medical Center within five days.
