INQUIRER: CBCP presses for FOI bill passage
The social action arm of the Catholic Bishops' Conference of the Philippines (CBCP) is urging Congress to pass the freedom of information (FOI) bill before it goes on recess for the election campaign period even without the certification of urgency from President Aquino. In a statement, Bishop Broderick Pabillo, chairman of the CBCP National Secretariat for Social Action, also warned that candidates under Aquino's Liberal Party-led coalition might lose their credibility if the FOI bill remained merely as a "pie dream" for the Filipinos.

MLA STANDARD: GMA ASK COURT TO DROP PLUNDER CASE
Former pres Gloria Arroyo, who has been held under hospital arrest for several months on charges of plunder, said on Sunday the case against her was never established in preliminary investigation by the Ombudsman but the SC sat on her petition to stop her indictment. Arroyo's lawyer, Rodolfo Jimenez, in a new petition to the SC, said they sought outright dismissal of the P365.9M plunder case for lack of probable cause. "There is no probable cause for the plunder charge against petitioner Gloria Macapagal-Arroyo. The charges against her should be dismissed outright," Jimenez said.

PHILSTAR: Through her lawyer Rodolfo Jimenez, Arroyo said the necessary elements of plunder under RA 2080 have not been established in the preliminary investigation conducted by the Office of the Ombudsman. He cited 21 cases wherein the SC upheld the existence of of reasonable doubt in acquitting an accused in a criminal case. In the case of People vs Avila, the SC held: "IT IS NOT THE DUTY of an accused to prove his innocence before the prosecution proves the his guilt, but rather it is the reverse, that is, THAT THE PROSECUTION MUST PROVE the guilt of the accused beyond reasonable doubt before the accused is put to proving his freedom and legal responsibility."
