PHISTAR: ATTY. BENJIE SANTOS - "Under the Constitution, every accused has the right to bail and the former president is invoking this right." Santos said every accused, even those facing capital offense that is punishable with life imprisonment, have the right to post bail if there is no strong evidence of guilt. He said the right to bail for every accused is enshrined in the 1987 Constitution, particularly in the bill of rights, which is implemented in the rules of criminal procedure. This includes the right to temporary liberty of an accused if there is no strong evidence of guilt. Santos said there is no strong evidence that would link Arroyo to the alleged tampering of votes during the May 2007 midterm elections in Maguindanao
