We have today filed a Motion for Judicial Determination of Probable Cause with the Sandiganbayan upon the ground that the evidence presented failed to establish probable cause that former Pres. GMA committed the crime of Plunder. We started preparing our motion ever since the Ombudsman has made public pronouncements weeks ago that there was a "strong case for Plunder against former Pres GMA - this even while the Office of the Special Prosecutor to whom she referred our Motion of Reconsideration for resolution was evaluating the case. By making her public pronouncements before the OSP issued and submitted its Resolution to her, the Ombudsman betrayed her clear prejudgment of the case and inability to decide the same with the required cold neutrality of an impartial judge. We have faith and confidence that the Sandiganbayan will live up to the ideals of the judiciary.
